Does My Insurance Protect Me In A Business Lawsuit?

Certain cases may be covered by insurance. For instance, if someone comes to your office and you find out later that they’re serving you a lawsuit because they tripped and fell while in your office, you may have some type of insurance that will protect you. You can have insurance for loss of income if the building burns down. The first thing you want to always do is see if you have any insurance that can protect you. You may have a policy that covers you in situations of sexual harassment, wrongful termination, or anything along those lines. The first thing you want to do is take out all your insurance policies and check with your attorney to see if you are covered.

If you wait too long, you’ll have a situation where the insurance company should’ve paid but you didn’t notify them, so they can may get out of paying the claim. If you have insurance, have your attorney contact your insurance company right away. A lot of times, they’ll send you a letter called Reservation of Rights, stating that you have a 30-day timeframe, but that doesn’t mean they’re going to cover you.

There’s a difference between litigation which involves lawsuits and transactional, which involves transactions. Most attorneys handle one or the other. It’s important to go to an attorney who can handle your specific situation. If you are in a situation where you’re being sued, you’re going to continue operating. You may have to make an adjustment, however. If you’re being sued for wrongful termination, for example, your attorney may suggest that you readjust your employee policy.
